Assault & Battery

Facing criminal charges of any type is something that can produce a range of emotions, including confusion, embarrassment, and fear. Dena has a comprehensive understanding of the relevant statutes and a history of securing positive outcomes for clients. Assault and battery convictions can and do cause hardships which follow individuals and their loved ones for decades. That is why it is imperative that you contact an experienced attorney ASAP. Dena has been very successful in Assault and Battery trials. In the instance when there is no viable defense, Dena will work out the best possible plea deal with the intent to minimize your exposure.

Assault is an intentional action placing another individual in fear of imminent harmful or unwanted contact. No actual physical contact is necessary for an assault to occur, provided that the victim feared immediate harm due to the intentional act of the accused.

Battery is any type of unwelcome touching that could be characterized as battery, even if no discernible injury was suffered. Unwanted physical contact is required.

A conviction of a simple assault or assault combined with battery without any other prior convictions is a misdemeanor offense punishable by a jail term not longer than 93 days.

If it is your second offense, you can face upwards of one year’s imprisonment and/or a hefty fine, making it imperative to seek legal representation.

Domestic Violence

Domestic violence charges are taken very seriously in Michigan and  carry serious consequences. In today’s political climate, prosecutors are bringing down the hammer on offenders who commit violent acts against their spouses, family members, housemates, and romantic partners.

One of the most common questions is “what if my girlfriend/boyfriend wants the charges dropped, or what if they refuse to testify?” In most instances, a prosecutor is not going to drop the charge of domestic violence because the accuser does not want to press charges. Similarly, if the accuser refuses to appear to trial, they will be subpoenaed by the state of Michigan and failure to appear has its own consequences. That is why it is important to get an attorney right away, instead of relying on the accuser to change their story or request that charges be dropped.

Domestic relationships can sometimes be very difficult to navigate.  As human beings we all make mistakes, especially when emotions are running high. At the same time, people are wrongfully accused everyday, either because they were actually the first offender, or to gain leverage in a divorce or custody matter. At Dena R. Horvath, PLLC, we’ve seen all of these scenarios. Fortunately, Dena has a very high success rate in Domestic Violence jury trials. She has also successfully had clients admit responsibility without any conviction on their record. The first consultation is free.
